Pfizer Inc. (PFE) and its subsidiaries (“Pfizer”) have agreed to pay $50 million to settle allegations that they illegally marketed and sold drugs to treat erectile dysfunction (ED) by artificially impeding blood flow to the penis. The settlement resolves allegations that Pfizer marketed, sold and promoted Viagra (sildenafil) to treat erectile dysfunction.
The lawsuit, brought by Pfizer, alleges that Pfizer illegally marketed Viagra (sildenafil), a drug used to treat erectile dysfunction, by selling it in excess of the value of 100 million American dollars in savings. Viagra and the other drugs used to treat erectile dysfunction include the brand name, Levitra (vardenafil), and the generic version, Cialis (tadalafil).
“Pfizer’s product sales were in excess of the value of the company’s profits, and it is unlawful to market or sell this drug to consumers,” the suit states. “Pfizer is entitled to have the full costs of the litigation under the settlement agreements for each of the three drugs and the other drugs covered in the settlement agreements for each drug.
“Pfizer has no duty to settle the litigation for the full costs of the settlement.”
According to the suit, Pfizer’s sales of Viagra (sildenafil) to treat erectile dysfunction were in excess of the value of Pfizer’s profits, and it is unlawful to market or sell this drug to consumers. “Pfizer is not liable for any costs of litigation in this litigation unless the company recovers adequate funds and a full record of all settlement and litigation results,” the lawsuit states.
The lawsuit also alleges that Pfizer’s actions “promptly caused consumers to receive illegal marketing and sale of prescription drugs and/or promoted the sale of prescription drugs for unapproved uses.”
Pfizer is also ordered to pay $4.1 million in penalties to victims of its alleged illegal marketing of Viagra, the suit alleges.
“The actions of Pfizer in this matter have been inconsistent with the obligations and expectations of the federal and state governments and the pharmaceutical industry,” it states.
